Can You be Responsible for Somebody Else’s Tax Liability?

Posted on November 12, 2012

If the IRS serves a levy upon you regarding a tax liability owed to the IRS by somebody else, can you also be held liable for that other person’s tax liability?  The answer may be yes.  In a recent District Court case, a woman died and left over $200,000.00 to her son.  The IRS served a levy upon the executor of the estate in respect of the son’s unpaid tax liability.  The executor disregarded the IRS levy and paid the money to the son.  The IRS held the executor personally liable for the money he paid to the son that should have been paid to the IRS.  Have you received a levy for somebody else’s tax liability?  Call us, we can help.  Call 877 4 IRS LAW
