Are payments made to a former spouse deductible on your income tax return? It depends on the language used by the parties or the court in the divorce proceedings. The general rule is that alimony or separate maintenance payments are deductible by the payor and includible in income by the recipient provided that the strict terms of the Internal Revenue Code are met.
