If you are following the criminal trial of former Trump campaign chairman Paul Manafort, you have learned that his accountant, Cindy Laporta, the preparer of Manafort’s tax returns, knew that the tax returns contained false information when she prepared them. Filing a tax return that you know contains false information is a criminal offense, a felony punishable by imprisonment for a period greater than one year. Worse yet, conspiring with another person, such as your accountant or tax attorney, to file a false or fraudulent tax return (or any other document) with the IRS is also a felony punishable by imprisonment for a period greater than one year. In choosing an accountant or tax attorney, choose only those individuals with the highest ethical standards. If your tax professional guarantees that they can “get you a large refund” and is willing to place (or suggests placing) inaccurate or untruthful information on your tax returns, not only should you immediately run away from this individual, but you should also report this individual to the appropriate governing body. For CPAs in Illinois, that governing body is the Illinois CPA Society, the American Institute of Certified Public Accountants and/or the Illinois Department of Financial and Professional Regulation. For attorneys, it is the Illinois Attorney Registration and Disciplinary Commission. The prospect of going to jail in order to get a larger refund or to reduce your tax bill simply does not make sense.
