Illinois Department of Employment Security (IDES) Liability


The IDES is an Illinois state agency that collects unemployment taxes and handles unemployment benefits. Most employers are required to pay quarterly contributions (unemployment taxes) to the IDES.

Prior to January 1, 2012, any liability due to the IDES by a corporation was a non-Trust Fund type tax, meaning that the IDES could not personally assert any unpaid liability against the owners, officers, shareholders or other responsible individuals of a business. However, beginning January 1, 2012, the IDES can now assert personal liability against the people that run a corporation.
